Contest Rules & Regulations
A. CONTEST DATES
The Make a Note of Mentoring with The Tenors Contest will run from January 12, 2015 to March 30, 2015.
Contest entry and video submission period:
January 12th, 2015, at 9 a.m. EST to February 25th, 2015, at 5 p.m. EST
March 2nd, 2015, at 9 a.m. EST to March 30th, at 5 p.m. EDT
Announcement of winning choirs:
April 2nd, 2015, at 9 a.m. EDT
B. CONTEST ENTRY FEES
There are no contest entry fees for choirs or musical acts interested in taking part in the contest. (“Participating Choirs/Acts”)
C. GENERAL ELIGIBILITY REQUIREMENTS
The contest is open to all Canadian choirs and/or musical acts. A Canadian choir/musical act is defined as based in Canada and whose members are all Canadian residents. Providing all other general eligibility requirements described herein are met, all professional and amateur Canadian choirs and/or musical acts of all types and voice combinations are eligible to enter the contest.
Only one video entry per Participating Choir/Act is allowed.
Participating Choirs/Acts must submit a video performance of one minute or longer of their interpretation of the song ‘I Thank You’ by The Tenors.
D. CONTEST SUBMISSIONS
To enter the contest, Participating Choirs/Acts must, by February 25th, 2015, at 5 p.m. EDT, (i) complete and submit an entry form and provide all other required documents, as indicated on the contest website at website link, and (ii) upload a video to the website that meets the requirements specified in these Contest Rules.
Participating Choirs/Acts must appoint a representative 18 years of age or older in their contest entry form. This Representative may be a member of the Participating Choir/Act or the parent or guardian of a member of the Participating Choir/Act.
Along with the contest entry, the Representative must confirm that all of the members of the Participating Choir/Act have consented to (i) take part in the contest, (ii) abide by the Contest Rules, which includes agreeing to be represented for the purposes of this contest by the Representative, who will receive all related correspondence and accept any prizes on the Participating Choir/Act’s behalf, and (iii) have their likeness and voice as well as personal information used and shared pursuant to the terms of these Contest Rules. By entering the contest, the Representative confirms that the consent of all members of the Participating Choir/Act has been obtained. Big Brothers Big Sisters of Canada and its agencies, affiliated companies, its partners, any companies acting on its behalf, including each of their directors, officers, employees, volunteers, sponsors, independent contractors, agents and authorized representatives (the “Releasees”) waives all liability in the event of a dispute arising between the members of a Participating Choir/Act in relation to this contest.
Members of a Participating Choir/Act who are under 18 years of age must have the consent of a parent or guardian to take part in the contest. Big Brothers Big Sisters of Canada reserves the right at any moment to require written proof of consent and to disqualify any member of a Participating Choir/Act who has not obtained this authorization.
An email will be sent to the Representative 24 to 48 hours after their entry has been submitted to officially confirm the Participating Choir/Act’s participation in the contest.
Odds of winning depend on the number of Participating Choirs/Acts and the number of votes received.
E. AUDIO TRACKS AND MUSICAL ARRANGEMENTS
Participating Choirs/Acts may use their own musical arrangements or the arrangements of another artist, provided they obtain in advance the required consent to use and broadcast any such material. See section J, “Intellectual Property,” for further details.
Participating Choirs/Acts who wish to purchase the audio track of the original version of their selected song may do so at their own expense.
F. VIDEO REQUIREMENTS
Participating Choirs/Acts must produce and upload a Web-ready video, following the instructions outlined in section D, “Contest Submissions.”
All video formats (AVI, MOV, MPEG, WMV, etc.) are welcome. Maximum file size is 500 MB.
Big Brothers Big Sisters of Canada reserves the right to reject any video entries deemed ineligible, specifically those that do not comply with the contest requirements and those that exhibit unacceptable behaviour within the framework of the contest. Should a situation of this nature occur, an email explanation will be sent to the Participating Choir/Act’s Representative. The Participating Choir/Act may then submit a second video entry that takes into account the concerns expressed by Big Brothers Big Sisters of Canada in the email. The original contest entry and video submission deadlines will still apply.

Each vote will be cast in exchange for a $5 donation to Big Brothers Big Sisters in Canada.*
There are no restrictions with regard to the source of donations, as long as the method of payment is one of the accepted choices within the scope of the contest (Visa, MasterCard or American Express, Paypal).
Voters may vote online as many times as they wish and may vote multiple times every day, either for the same choir/act or for different choirs/acts, in exchange for a $5 donation for each vote, as described above.
Choir/Act members may vote for their own choir/act.
Before completing their transaction, voters are responsible for ensuring that the number of votes they wish to cast for a given choir/act corresponds to the amount of the donation they would like to make to Big Brothers Big Sisters in Canada. No refunds will be issued.
H. TAX RECEIPTS
Tax receipts will be issued for every eligible transaction, i.e., every transaction conducted by an individual (including transactions carried out on behalf of another person, where the latter has officially designated a third party to make donations on their behalf) and every transaction conducted on behalf of a legally incorporated enterprise (corporation, legal entity, etc.). Transactions conducted on behalf of a group that is not a legally incorporated enterprise are not eligible to receive a tax receipt.
Once the voting period is closed, the top 15 choirs and/or musical acts with the highest number of votes will receive a Runner-Up Prize of $1,000 back from Big Brothers Big Sisters.
In the event of a tie for 15th position, the tied choirs/acts will receive the same prize as the other 15 winners.
Once the voting period is closed, one of the 15 choirs or musical act with the most votes will be chosen - by a panel of three judges - to win the grand prize of a private jam session with The Tenors.**
All decisions are final.
The judges will make their selection based on the following criteria:
- Quality of vocal performance (50 %)
- Quality of overall performance (50%)
One Grand Prize will be awarded, namely:
The honour of a jam session with The Tenors.**.
Big Brothers Big Sisters’ sole responsibility is to award the prizes as described in these Contest Rules and to pay for travel & accommodation costs for The Tenors to get to the private jam session. Winning choirs/acts are responsible for paying all other costs and expenses related to the awarding of the prizes.
The names of the 15 winning choirs/acts for the runner-up prize will be announced after the voting period ends on March 30, 2015, at 5 p.m. EDT.
The judges’ favourite & winning entry will be announced on April 2, 2015, at 9 a.m. EDT. The complete list of winning choirs will be published on the home page of the contest website as of this date.
Only the winning choirs/acts will be contacted, via an email or telephone call to their Representative. In the event Big Brothers Big Sisters cannot reach the Representative of a winning choir/act within 60 days, the choir/act will lose its winning status and will no longer be entitled to receive the prize.
Once the Representative of a winning choir/act has been contacted, they will have 30 days to submit a signed contest waiver and release form and, as appropriate, a publicity release form to Big Brothers Big Sisters of Canada. Within 30 days of receiving this document (to be provided by Big Brothers Big Sisters of Canada), Big Brothers Big Sisters will mail a cheque for the prize amount of $1,000 to the winning choir/act’s Representative.
J. INTELLECTUAL PROPERTY
Representatives of each Participating Choir/Act will confirm that their choir/act has all the necessary authorizations to use the images and contents in their video and is legally entitled to perform the song as submitted (copyright on musical arrangements, etc.). Participating Choirs/Acts must provide proof of said authorizations to Big Brothers Big Sisters of Canada upon request. Big Brothers Big Sisters of Canada reserves the right to reject any video entry deemed ineligible because a Participating Choir/Act has not provided this proof as required.
By submitting a video entry to the contest, Participating Choirs/Acts transfer all corresponding rights to Big Brothers Big Sisters of Canada. All submitted videos become the exclusive property of Big Brothers Big Sisters of Canada. Furthermore, Participating Choirs/Acts waive all moral rights over the video and transfer them to Big Brothers Big Sisters of Canada.
This transfer and waiver will be effective for an indefinite period and apply to all jurisdictions and all media.
By entering the contest, Participating Choirs/Acts automatically authorize Big Brothers Big Sisters of Canada and its agencies, its partners, affiliated companies, any companies acting on its behalf, including each of their directors, officers, employees, volunteers, sponsors, independent contractors, agents and authorized representatives, and other releasees to use all videos submitted and their contents, including the name, likeness and voice of the individuals featured in the video, in accordance with the needs of the campaign, during and after the contest (posting on the Big Brothers Big Sisters website, distribution for promotional purposes) and for all other non-commercial purposes related to Big Brothers Big Sisters in Canada.
No copyright, monies or benefits will be granted or owed by Big Brothers Big Sisters of Canada or by any other entity associated with Big Brothers Big Sisters of Canada.
Winning choirs/acts may not under any circumstances disseminate or use the submitted video or any other audio or video reproduction, including any of the songs suggested within the scope of this contest, in whole or in part, unless they have first obtained the legal consent of the holder of the corresponding copyright and related rights.
K. GENERAL TERMS AND LIMITATIONS OF LIABILITY
Personal information for members of Participating Choirs/Acts, including names, mailing addresses, email addresses, ages and telephone numbers, will be collected and used solely for administrative purposes in connection with this contest. Such information will not serve any other purpose without members’ consent. By providing this information, the members of the Participating Choirs/Acts consent for it to be used for the purposes outlined in these Contest Rules.
Any entries that are incomplete, contain erroneous contact information or include an identity that is subsequently proven to be false will be deemed null and void. Fraudulent entries will be rejected. Big Brothers Big Sisters of Canada reserves the right to disqualify from the contest any Participating Choir/Act whose conduct violates public policy.
Big Brothers Big Sisters of Canada and its releasees is not responsible for any votes or email addresses that are not tallied in the final results.
Big Brothers Big Sisters of Canada and its releasees is not responsible for typographical or other errors that may occur in connection with the operation or administration of this contest, including but not limited to errors in advertising, official Contest Rules, the selection of the winners and announcement of the winners’ names, regardless of whether caused by website users, by any of the equipment or programming associated with the contest or used in connection with the contest, or by any technical or human error that may occur in the administration of this contest.
The winning choirs must accept the prizes as awarded. Prizes are non-transferrable and cannot be substituted for another prize or sold or exchanged, in whole or in part, for cash. In the event a winning choir/Act refuses to accept a prize as awarded, Big Brothers Big Sisters of Canada, as well as its agencies, directors, officers and employees, and other releasees will be relieved of any responsibility or obligation toward the winning choir/act. Big Brothers Big Sisters of Canada and its agencies, directors, officers, employees, affiliates, and other releasees accepts no liability whatsoever in the event Big Brothers Big Sisters of Canada is unable to act as the result of a fact or situation that is unforeseeable or beyond Big Brothers Big Sisters of Canada’s control.
Big Brothers Big Sisters of Canada and each of Big Brothers Big Sisters’ agencies, directors, officers, employees, partners, affiliates, and other releasees make no warranty or representation of any kind concerning any award and are not liable for injury, loss or damage of any kind resulting from the acceptance or use of any prize or arising from participation in this contest. Big Brothers Big Sisters in Canada and its releasees will not be held liable if, as the result of a force majeure, an incident or incidents beyond the Big Brothers Big Sisters of Canada’s control or an act of fraud, it becomes necessary to suspend, defer, postpone, modify or cancel the contest.
In all cases, Big Brothers Big Sisters of Canada reserves the right to extend the contest entry period and postpone all stipulated dates upon reasonable notice. Any such extension or postponement will be announced on the home page of Big Brothers Big Sisters of Canada’s website and conveyed via email to the Representatives of each Participating Choir/Act.
Minor changes to these Contest Rules may be made by Big Brothers Big Sisters of Canada while the contest is underway, upon reasonable notice. Any such changes will be announced on the home page of Big Brothers Big Sisters of Canada;s website and conveyed via email to the Representatives of each Participating Choir/Act.
By entering the contest, Participating Choirs/Acts accept to abide by the Contest Rules herein, the implementation of which is the responsibility of Big Brothers Big Sisters of Canada. Big Brothers Big Sisters of Canada reserves the right to disqualify any individual or choir that does not comply with the Contest Rules in their entirety.
* Fifty percent of the net funds raised will be donated to the Big Brothers Big Sisters agency chosen by the musical act or choir with the remaining portion of the donation going to Big Brothers Big Sisters of Canada. If no agency is designated – the funds will be donated to Big Brothers Big Sisters of Canada.
** Date of jam session is subject to the availability of both parties.
